Hello everyone, I hope you all are doing well, happy Halloween!
The concept of Mistakes of facts would be the belief that you did not know you were doing something wrong, that it was an honest mistake that anyone could make. It goes against the need to have Mens Reas because there is no actual intent towards wanting to commit harm itself. To me, a good example is let’s say you go to a park after you have driven your brand new car to said park. While over there another brand new vehicle exactly like yours, color and all parks a few stalls next to you. When you come back from the other side you see that car and attempt to get in and struggle when the car won’t open. Other people and the owner of that vehicle call the police and now you must prove in court that it is a mistake of fact. You simply thought it was your vehicle and were trying to get in, if you had known it was not your vehicle then you would have never attempted to get in.
Moral wrong doctrine is the principle that states that even though they were wrong about the fact they were not justified morally. The moral wrong doctrine goes hand in hand with the mistakes of the facts ensuring that people take responsibility for their actions regardless of lack of intent. It is to ensure that there is no lack of responsibility for the crime being committed. This would push that the actor should have known better than to continue to struggle to open the car. That they should have known something was wrong and it was not their car and would be stolen property. The moral doctrine would be basically how people are supposed to conduct with one another ethically. The moral doctrine in turn would still punish as the actor should have known that stealing is morally wrong and that they should have known better.
The video we watch is very intriguing and it brings up valid issues when it comes to moral wrongs and illegals. Everything is different everywhere based on different moral backgrounds and different ethics and belief systems that are all unique and all ideas are validated. Not all beliefs are the same in one place and can be illegal in another such as labor, we go against child labor and find it legally and morally wrong but other countries might deem it normal. We are against harsh and unusual punishment while in other countries the weirder and harsher the better. Child brides are illegal here but okay everywhere else, eating pigs and cows is okay here but not in other countries as deemed morally wrong. Just because it is ethical to us does not make it morally right. I do hope my examples are on the dot as this is what I believe the video was trying to show the differences in between what is illegal and morally wrong/right depending on who is who and what is what.
